Are Employers allowed to ask about race?

 

Federal law does not prohibit employers from asking about your race. However, since these questions can indicate possible intent to discriminate, employers should only ask about your race for a lawful purpose, such as complying with government laws.

 

Is it illegal to discriminate against someone of your own race?

 

Yes. It is still illegal.

 

Can I be discriminated against if I am bi-racial or multi-racial?

 

Yes, bi-racial, and multi-racial job applicants and employees are protected from unfair treatment or harassment at work under the same laws.

 

Are white employees protected even though they are not a minority?

 

Yes. The law protects employees of all races.

 

Is it illegal for employers to discriminate against me because I have a friend or spouse of a different race?

 

Yes. The EEOC laws prohibit an employer from treating you differently because your friends, parents, spouse, or other people you associate with are of a particular race or color.

 

Can my employer assign me to work only with customers of my own race?

 

No. This is not legal. Your employer cannot ask you to work only with customers of your own race, even if the employer believes it will benefit you.

 

Can an employer base any job decisions on my race?

 

No. This includes refusing to hire you, firing you, refusing to promote or train you, or decisions regarding wages and benefits.

 

Can I be punished for reporting racial discrimination?

 

No. It is illegal for an employer to punish you, treat you differently, or harass you because you reported racial discrimination. This is known as retaliation and there are laws that protect you from it.
